1. Data Controller

2. Types of Data Processed
Pointel Communication S.p.A. processes the identification data you provide—such as first name, last name, address, email, and phone number—and does not process special categories of personal data referred to in Article 9 of the European Privacy Regulation (EU) 2016/679, 'Privacy Regulation' (i.e., sensitive, biometric, genetic, and criminal data).
The processing of data is limited to what is strictly necessary for the purposes described in paragraph 4 to provide you with the requested services.
3. Methods of Processing
Your data is processed with the support of IT and telecommunication tools and is protected through appropriate security measures designed to ensure its confidentiality and integrity.
In particular, Pointel Communication S.p.A. implements technical procedures (firewalls, antivirus, and other advanced technologies) suitable for protecting your data against loss, theft, as well as unauthorized use, disclosure, or modification.
Furthermore, data may be deleted at your request if you no longer wish to use our Services, or extracted from our systems and provided to you should you decide to exercise the right to data portability referred to in paragraph 9
4. Purpose of Processing
The purposes for which Pointel Communication S.p.A. needs to request and process your data arise either from your consent (when required) or from other reasons provided for by the Privacy Regulation, and more specifically:
Contractual Purposes
a. the use of the Portal and its functionalities
b. access to your personal page on the Portal and the Services offered through the portals, including technical assistance and support in case of issues
Legal Purposes
c. compliance with any legal and regulatory obligations and, where necessary, the enforcement and defense of the rights of Pointel Communication S.p.A. or third parties in legal proceedings
Marketing Purposes
d. only with your prior consent (which you may withdraw at any time, as indicated below in paragraph 9) for the promotion of products, including through the sending of advertising materials, commercial communications, market research, and direct sales activities, both via traditional communication methods such as postal mail and via remote communication tools, such as email, chat, phone, and SMS
e. only with your prior consent (which you may withdraw at any time, as indicated below in paragraph 9) for user profiling to make the promotional activities mentioned above better tailored to your needs, habits, and interests (Profiling Purposes)"
5. Legal Basis for Processing
a. Legal basis for processing for contractual and legal purposes
The processing of data for Contractual Purposes is mandatory as it is necessary for the provision of the services you requested.
Providing data for Legal Purposes is also mandatory, as required by applicable laws and regulations.
If you do not wish your personal data to be processed for these purposes, Pointel Communication S.p.A. will not be able to provide you with the requested Services and/or create an email account.
b. Legal basis for processing for marketing purposes: consent
The processing of data for Marketing Purposes is optional and is allowed only with your consent (which may be withdrawn at any time, as indicated below in paragraph 9). Without your consent, Pointel Communication S.p.A. will not be able to send you marketing communications, conduct market research, or carry out profiling activities as described above.
6. Data Sharing with Third Parties
Pointel Communication S.p.A. does not transfer data to third parties, except for sending any materials through the use of trusted couriers.
If the AVAILABILITY request is made through the AVAILABILITY form in the 'accommodation' section, the data is sent by email to the accommodation facility to which the booking request is made.
7. Types of Data Processed
Your data will not be transferred outside the national territory to countries within the European Union.
8. Users under 16
Users under the age of 16 may register on the site only with the consent of their parents or legal guardians. Pointel Communication S.p.A. may verify, at any time, the consent given by the adult exercising parental authority.
9. Data Subject Rights
You may exercise at any time the rights granted to you by law, including the right:
- to access your personal data, obtaining information on the purposes pursued by the Data Controller, the categories of data involved, the recipients to whom the data may be disclosed, the applicable retention period, and the existence of automated decision-making processes;
- to obtain without undue delay the rectification of any inaccurate personal data concerning you;
- to obtain, where applicable, the erasure of your data;
- to obtain the restriction of processing or to object to it, where possible;;
- to request the portability of the data provided to the company, that is, to receive them in a structured, commonly used, and machine-readable format, also to transmit such data to another controller, within the limits and under the conditions provided by Article 20 of the GDPR;
Furthermore, you may lodge a complaint with the Data Protection Authority pursuant to Article 77 of the GDPR.
For processing referred to in point 4(d) of the purposes, the Customer may at any time withdraw consent and exercise the right to object to direct marketing (both in 'traditional' and 'automated' forms). Unless otherwise specified, the objection will apply to both traditional and automated communications.
10. Exercise of Rights
You may exercise the rights mentioned above at any time, modify your contact preferences, notify Pointel Communication S.p.A. of any updates to your data, request the removal of personal data provided by third parties, or obtain further information regarding Pointel Communication S.p.A.'s use of your personal data by contacting Pointel Communication S.p.A. as indicated in point 1. You can also directly manage some of your data and modify your consents easily and independently by accessing the Account Management area, following authentication.
11. Data Retention Periods
Pointel Communication S.p.A. will retain the data until they are deleted by the user.
12. Changes and Updates
This privacy notice is effective from the date indicated in its heading. Pointel Communication S.p.A. may also make changes and/or additions to this notice, including as a result of any subsequent amendments and/or additions to the Privacy Regulation. Changes will be notified in advance, and you can view the constantly updated text of the notice at this same link.
